Terms of Service

These Terms of Service ("Terms") govern your use of the Pointbunny point-of-sale application and website (the "Service"), provided by Pointbunny ("Pointbunny", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Pointbunny is a point-of-sale and business-management application for small businesses. We may add, change, or remove features over time as we improve the Service.

• We record payments; we don't process them. Pointbunny records how your customers paid (cash, card, QR, and so on). Card and digital payments are processed by your own card terminal or payment provider, under your agreement with them.
• Receipts and tax. Pointbunny helps you calculate taxes and print receipts, but it is not a certified fiscal device or tax-filing service. You are responsible for making sure your tax rates, receipts, and invoice numbers meet the rules where you operate.
• Hardware. Printers, tablets, card terminals, and other devices are not part of the Service. We don't guarantee that every device will work with it.

2. Your account & responsibilities

• The Service is for business use. You must be at least 18 and able to agree to these Terms on behalf of your business.
• You must provide accurate information and keep your login credentials secure.
• You are responsible for all activity under your account, including any staff members you invite and the permissions you give them.
• You are responsible for the accuracy of the data you enter and for meeting your own legal, tax, and regulatory obligations (for example, charging and reporting the correct taxes).

3. Acceptable use

You agree not to misuse the Service, including by attempting to access other businesses' data, disrupting the Service, reverse-engineering it, or using it for any unlawful purpose.

4. Plans, trials & payments

• Free plan. You can use Pointbunny on the Free plan at no cost, with the limits shown in our pricing section.
• Free trial. New accounts get a 7-day trial of Pro features. No card is required, and you are never charged when it ends: your account simply returns to the Free plan unless you choose to subscribe.
• Pro subscriptions. Paid subscriptions are sold by our reseller, Lemon Squeezy, which acts as the merchant of record. Lemon Squeezy handles your payment, invoices, and any sales tax or VAT, and its own terms apply to the purchase. Prices are shown in our pricing section and may change with advance notice; a price change applies from your next billing period.
• Renewal and cancellation. Subscriptions renew automatically until cancelled. You can cancel at any time from your billing settings, and Pro stays active until the end of the period you've paid for. After that, your account returns to the Free plan: your data is kept, but Pro features are locked until you subscribe again.
• Refunds. Except where required by law, payments are non-refundable.

5. Your data

You own the business data you put into Pointbunny. You grant us the limited rights needed to host and process it so we can provide the Service. How we handle personal data is described in our Privacy Policy.

If you store information about your own customers or staff (for example, loyalty members' names, phone numbers, and birthdays), you are responsible for having the right to collect it and for telling them how you use it. We process that information only on your behalf, to provide the Service.

You can export your sales, reports, and timesheets as CSV files from the app at any time, and you can ask us for a copy of your other data.

6. Intellectual property

The Service, including its software, design, and branding, is owned by Pointbunny and protected by law. These Terms do not grant you any ownership of the Service itself.

7. Availability & "as is"

We work to keep the Service reliable but do not guarantee it will always be available or error-free. The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, Pointbunny will not be liable for any indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the Service. Our total liability is limited to the amount you paid us in the twelve months before the claim.

9. Third-party services

The Service works with services we don't control, such as Google sign-in, Lemon Squeezy billing, and your own payment provider and devices. We aren't responsible for those services, and your use of them is governed by their own terms.

10. Termination

You may stop using the Service at any time, and you can ask us to delete your account and data by emailing support@pointbunny.com. We may suspend or terminate access if you violate these Terms. Before your account is deleted, you may request an export of your data. We may keep some records where the law requires it.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you where appropriate.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
